Terms and Conditions
1) Terms
These terms and conditions form the complete agreement under which you, as a seller, will do business with us (Designer Dress Agency). We may at any time update these terms and conditions by notifying you in writing or by publishing new terms and conditions on our website www.designerdressagency.co.uk. Any new terms and conditions will supersede these from their time of publication or time of writing to you. These terms and conditions are governed by the laws of England and Wales. Any dispute shall be subject to the jurisdiction of English Courts.
2) Services
We will collect (where agreed) and hold your items for sale for a minimum of 6 months. We undertake but do not guarantee to sell these items on your behalf. We will collect payment from the buyer and pay any fees. We will arrange delivery to the buyer and deal with any returns. Once payment is cleared and the returns period of 14 days is over, we will send payment to you less our fees. We may wait for other items in your batch to clear before processing payment.
3) Our sales
It will be entirely at our discretion how to sell items or how to list the items in auction. We will set reserves or minimum prices where we choose, except when a specific reserve or price has been agreed on the items list. The final price will be determined by the highest price or bid which we reasonably accept. Upon receipt of payment from the buyer, you pass title of ownership directly to them. We will not take ownership of any item as part of this process. If the buyer returns the item within 7 days we may offer the item to others, or re-sell it.
4) Our liability.
Every reasonable effort will be taken to ensure that items are stored and kept in the condition in which they were received except where permission has been given for repairs or cleaning to be undertaken by Designer Dress Agency on your behalf. Designer Dress Agency cannot accept responsibility for any loss or damage as a result of cleaning or repairs undertaken by a third party. We are not liable for any loss or damage – direct, consequential or loss of profit that you may suffer as a result of this agreement. In particular we make no representation about the selling price except when a price has been agreed upon prior to listing.
5) Fees
Each item will be subject to a commission 50% of the final sale price. Cost of repairs and/or return of items will be quoted separately for your job. If an item does not sell Designer Dress Agency may undertake to sell the item again or return the item (cost of return to be paid by you and to be invoice separately to fees described above) or if agreed may dispose of the item by depositing at the clothes recycle centre. We are not obliged to re-sell or dispose of items and can choose to return them to you at your cost at any time. Provided we have made all reasonable attempts to contact the seller, we reserve the right to retain 100% of any fees not claimed within three (3) months of the date of this agreement.
6) Your personal information
We will hold your personal information electronically. We will use this information to deal with you in the normal course of doing business with you. We may from time to time wish to contact you with information and offers. We will ask you to opt-in to this when you sign up, and you may opt-out of this at any time by e-mailing us at info@designerdressagencyco.uk. We will never sell your information to a third party, and will only disclose it where we are obliged to in order to resolve a dispute or are compelled to by law.
7) Your obligations
When consigning any of your items for sale, you warrant that they are your own and that you are not constrained from selling them in any way. You warrant that the item description in the items list is not misleading in any way. You indemnify us for any loss or damage due to inaccuracies in the description on the items list, or any actions you take which affect the sale.
